The National Anthem Law of the People's Republic of China, adopted at the 29th Session of the 12th NPC Standing Committee of the People's Republic of China on 1 September 2017, is hereby promulgated, effective October 1, 2017.

Article 1
This Law is enacted in accordance with the Constitution to maintain the dignity of the national anthem, to standardize the singing, playing and use of the national anthem, to enhance the citizens' concept of nation, to inspire patriotism, and to cultivate and practice the socialist core values.

Article 2
The national anthem of the People's Republic of China is the "March of the Volunteers".

Article 3
The national anthem of the People's Republic of China is a symbol and embodiment of the People's Republic of China.

All citizens and organizations shall respect the national anthem and maintain its dignity.

Article 4
People shall sing the national anthem in the following circumstances:

(1) Opening and closing of sessions of people's congress at all national and local levels;

Opening and closing of sessions of all national and local committees of the Chinese People's Political Consultative Conference;

(2) All levels of representative assembly of all political parties and people's organizations;

(3) Constitutional oath ceremonies;

(4) Flag raising ceremonies;

(5) Major celebrations, award ceremonies and commemorations held or organized by government agencies at all levels;

(6) National memorial day events;

(7) Important diplomatic occasions;

(8) Major sport events;
and

(9) Other suitable occasions.

Article 5
The state encourages citizens and organizations to sing the national anthem in the appropriate occasions to express their patriotism.

Article 6
The national anthem shall be sung according to the lyrics and music stated on the Appendix hereto, and shall not take any disrespectful form.

Article 7
When the national anthem is played, all the persons present shall be solemn and act in a dignified manner, and shall not conduct any disrespectful activity.

Article 8
The national anthem shall not be used or disguisedly used for any trademark or commercial advertisement, or adopted in inappropriate occasions such as private funerals, or taken as background music at public places.

Article 9
The provisions on occasions and etiquette rules for singing the national anthem in diplomatic events shall be formulated by the Ministry of Foreign Affairs.

The provisions on occasions and etiquette rules for singing the national anthem in the army shall be formulated by the Central Military Commission.

Article 10
When singing the national anthem on an occasion specified in Article 4 of this Law, citizens and organizations shall adopt the standard performance music of the national anthem or the official recorded version of the national anthem.

The Ministry of Foreign Affairs and diplomatic missions abroad shall provide relevant national diplomatic departments and relevant international organizations with the standard performance music and official recorded version of China's national anthem for application on diplomatic occasions.

Sports administration department of the State Council shall provide to relevant international sports organizations and competition event organizers with the standard performance music and official recorded version of China's national anthem for application in international sport events.

The standard performance music and official recorded version of China's national anthem shall be examined, approved and recorded by the department designated by the State Council, and be released on the websites of the National People's Congress and the Chinese Government

Article 11
The national anthem shall be included in textbooks for primary and secondary school students.

Primary and secondary schools shall take the national anthem as an important element in patriotism education, organize students to sing the national anthem, explain to students the history and spiritual connotation of the national anthem, and require students to follow the etiquette rules of the national anthem.

Article 12
News media shall conduct active publicity for the national anthem to publicize etiquette rules of the national anthem.

Article 13
On national statutory holidays and memorial days such as National Day and International Workers' Day, the radio stations and television stations of the State and various provinces, autonomous regions and centrally-administered municipalities shall play the national anthem at the time as stipulated by the radio and television department of the State Council.

Article 14
People's governments at and above county level and their relevant departments shall, within their respective authority, supervise the singing, playing and use of the national anthem.

Article 15
Whoever deliberately tampers with the lyrics or music of the national anthem, plays/sings the national anthem in a distorted or disparaged way, or otherwise insults the national anthem in any other way will be given a warning or detained for not more than 15 days by the public security authority. If a crime is committed, he shall be held criminally liable according to law.

Article 16
This Law shall come into force on October 1, 2017.
